Your raffle ticket purchase helps PEC protect and restore

Pennsylvania's environment and communities.

No more than 1,000 tickets will be sold. Winning number will be the PA Daily Number (straight, evening drawing). If the raffle ticket for the PA Daily Number has not been sold, ten winners will be drawn from a pool of raffle tickets sold, each winning $250 cash.

Drawing: 7:00 p.m. EDT on Saturday, April 14, 2012 at Corinthian Yacht Club 300 W. 2nd St. Essington, PA. Winner need not be present. Permit #406100. Please read official rules and regulations below.


Pennsylvania Environmental Council 2012 Raffle

Official Rules and Regulations

The Pennsylvania Environmental Council, Inc. ("PEC"), a nonprofit Pennsylvania corporation, is a tax-exempt organization under state and federal laws. PEC is conducting this raffle as a way to raise funds to cover a portion of the costs of ongoing programs and projects. The official rules and regulations of the PEC 2012 Raffle are set forth below. By purchasing a raffle ticket, you agree to be bound by these rules and regulations. PEC's interpretation and application of the rules and regulations shall be final.

Tickets

Raffle tickets are $25 each; and $50 for three tickets. No more than 1,000 tickets will be sold. Raffle tickets must be purchased by 6:50 p.m. EDT on Saturday, April 14, 2012. All sales transactions are final. No refunds. Only ticket holders with validly paid tickets are eligible to participate in the raffle. Only one eligible person may be entered in the raffle per ticket sold. PEC will record the name and contact information of that person as the holder of record of that particular ticket. Prizes will be awarded only to the holder of record of a winning ticket. If the name of more than one person is submitted with a ticket purchase, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Division of a prize by a group purchasing a ticket in common shall be the sole responsibility of the person named as the holder of record of that ticket, should that ticket be selected as a winner. PEC assumes no responsibility for lost, late, misdirected or non-delivered mail or other failure to deliver tickets prior to any deadline.

How to Purchase

Tickets may be purchased from an employee or agent of PEC, and paid for by cash, check, or credit card (made to the order of "Pennsylvania Environmental Council"). Purchases may also be made at http://www.pecpa.org. Please note that you will not be deemed entered into the raffle until your payment is received and confirmed by PEC. You may buy as many available tickets as you want.

Selection of Winners

The winning ticket will be the ticket that exactly matches (straight) the three digit number selected by the Pennsylvania Daily Number (evening drawing) on or about 7:00 pm EDT Saturday, April 14, 2012 at the Corinthian Yacht Club, 300 W. 2nd Street Essington, PA.  Ticket holders do not need to be present to win. The winner will be notified by phone, U.S. mail or email, according to the contact information provided to PEC at the time of ticket purchase. The odds of winning a prize will depend on number of raffle tickets sold.

If the raffle ticket containing the exact match for said Pennsylvania Daily Number has not been sold, ten ticket stubs will be drawn at random at the same time and location. PEC will conduct the drawing.

Eligibility

You must be 18 years of age or older, have a valid drivers' license, and be a resident of the United States to purchase tickets or win the prize. All federal, state, and local laws and regulations apply. The raffle is void where prohibited or restricted by law.

Prize

The Grand Prize consists of $5,000 cash. If the raffle ticket for the Pennsylvania Daily Number has not been sold, ten randomly selected ticket holders will receive $250 cash each.

Restrictions

Grand Prize. Winner of the Grand Prize shall be subject to verification of compliance with these rules and regulations, and may be required to execute liability release and affidavit of eligibility/publicity release. Winner assumes and is solely responsible for payment of all local, state, and federal taxes, as well as all incident expenses not mentioned herein. The winner will be issued a 1099 tax form for the value of the prize, $5,000. Prizes are non-transferable, and no substitutions for cash or other prizes permitted by winner (although the Pennsylvania Environmental Council may substitute prizes at their discretion). Second Prize. No substitutions shall be allowed for the Second Prize. The winner will be issued a 1099 tax form for the value of the prize, $2,50.00. The Internal Revenue Service has taken the position that amounts paid for chances to participate in raffles, lotteries, or similar programs do not qualify as a deductible charitable contribution; check with your qualified financial advisor for additional information.

If the winner cannot be located by 5:00 p.m. June 30, 2012, after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited the prize. Another winner will not be selected for the prize. Winners must claim the prize within fourteen (14) days after notice of the award. If a winner does not claim the prize within said fourteen (14) day period, such winner will be deemed to have forfeited the prize and another winner will not be selected for the prize. The name of the winner may be obtained by request, in writing, by sending a SASE to 130 Locust Street, Suite 200, Harrisburg, PA 17101.

PEC reserves the absolute right to cancel the raffle, for any reason or at any time, regardless of whether tickets have already been sold. In the event of cancellation PEC will return the ticket purchase price cost to all entrants without obligation to pay any interest whatsoever.

General Terms and Conditions

By purchasing a raffle ticket, you accept and agree to be bound these Rules and Restrictions and the decisions of PEC, which shall be final; and you further agree that your name and/or likenesses may be disclosed to and used by the news media and may otherwise by used by PEC for publicity purposes in print or on the internet. The name of the winner may be submitted to the office of the Attorney General of Pennsylvania or the Internal Revenue Service, as required by law. Other rules and regulations may apply. PEC's interpretation and application of the rules and regulations shall be final.

By purchasing a raffle ticket, each participant releases PEC, their directors, officers, employees, volunteers and agents from any and all liability for injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession, use or misuse of the prize, and the winner agrees to indemnify and hold PEC harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of the winner's acceptance or use of the prize.

Disclaimer of All Other Representations and Warranties

THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS. PEC DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RAFFLE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. A RAFFLE PARTICIPANT'S SOLE AND EXCLUSIVE REMEDY FOR PEC BREACH SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER RAFFLE TICKET(S).

IN NO EVENT SHALL PEC BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF PEC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ANY CLAIM OR DISPUTE AGAINST PEC WITH RESPECT TO THE RAFFLE MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ARISES.
